Terms of Service

These Terms of Service (“Terms”) govern your use of the Vestimentum mobile application (“App”, “Vestimentum”). By using the App you agree to these Terms.

Vestimentum is developed by Oğuzcan Özüpek (“we”, “us”, “our”). Contact: support@vestimentum.app

Our privacy practices are described separately in the Privacy Policy.

1. Acceptance of Terms

By downloading and using the App, you represent and warrant that:

• You have read, understood, and agree to these Terms and the Privacy Policy,
• You are at least 13 years old,
• All information you provide is accurate and current,
• You have the legal capacity to enter into a binding agreement.

If you do not agree to these Terms, do not use the App.

2. Eligibility

2.1 Age Requirement

Vestimentum is available only to users 13 years of age and older. If you provide a date of birth at signup, the system automatically rejects DOBs that imply under-13.

2.2 Geographic Restrictions

The App is available worldwide; however, certain features (e.g., Vestimentum+ subscriptions) may not be offered in some jurisdictions.

2.3 Prohibited Users

Persons on the OFAC sanctions list, the EU sanctions list, or similar international restricted lists may not use the App.

3. Account Responsibilities

3.1 Account Security

• You are responsible for the security of your account. Choose a strong password and do not share it with anyone.
• Notify us at support@vestimentum.app immediately if you discover unauthorized access.
• We are not liable for losses arising from your negligence in account security.

3.2 One Account Per Person

A single person should maintain only one active account. Additional accounts may be terminated if detected.

3.3 Accurate Information

The profile information you provide (name, date of birth, location) must be accurate. Providing false or misleading information violates these Terms.

4. License to Use the App

4.1 License Granted

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Vestimentum for personal, non-commercial purposes.

4.2 Restrictions

You agree not to:

• Reverse engineer, decompile, or extract source code from the App.
• Copy, reproduce, sell, or rent the App or any part of it to third parties.
• Use our API with automated tools (bots, scrapers).
• Engage in activity that would damage or overload our systems.
• Attempt to bypass the App’s security features.
• Use the Vestimentum brand or logo without permission.

5. User Content

5.1 Ownership

All clothing photos, names, notes, captions, and other content you upload (collectively, “User Content”) remain your property.

5.2 License You Grant Us

When you upload User Content, you grant us and our service providers a worldwide, royalty-free, transferable, sub-licensable license to:

• Host, store, back up, and display the content,
• Process the content for AI models (classification, background removal, outfit suggestion generation),
• If you share an outfit, display abstract/silhouette representations of the content (not the actual photographs) to other users in Discover and similar features.

This license exists solely to operate the App. We do not use your content for advertising, sale, or AI model training.

5.3 Discover Posts

When you tap “Share”, outfit metadata (colors, categories, abstract illustrations) becomes visible to other Vestimentum users. Your real clothing photos are never shared — the Discover feed uses only abstract silhouettes.

When you delete a post, it is permanently removed from our servers; however, cached copies on other users’ devices may persist for some time.

5.4 Your Responsibility for Content

You are responsible for all User Content you upload. You warrant that the content:

• Does not infringe third-party copyrights or trademarks,
• Is not unlawful,
• Does not contain personal data (faces, ID information) of other people without their consent.

6. Acceptable Use

You agree not to use Vestimentum for any of the following:

• Creating content that violates applicable law or the rights of others
• Posts that harass, incite hatred, or discriminate
• Sexual, obscene, or content that sexualizes minors
• Content that promotes violence, self-harm, or illegal drug use
• Misleading other users with false / deceptive outfit suggestions
• Spam, phishing, or distributing malware
• Impersonating other users
• Overloading our systems with automated tools (DDoS, scraping)

Accounts that violate these rules may be terminated without notice.

7. AI Suggestions — Disclaimer

Vestimentum’s outfit suggestions are generated by AI (Claude). These suggestions:

• Are not professional styling advice.
• Are not medical, financial, or legal advice.
• May differ from your individual style, culture, situation, physical features, or personal preferences.
• May contain inaccurate or inappropriate suggestions.

You are responsible for evaluating suggestions with your own judgment. If you are uncertain about a suggestion’s appropriateness, seek a second opinion from a professional stylist or someone you trust.

AI clothing classifications (category, color) may also be incorrect. You can fix misclassified items from Profile → garment detail.

8. Subscription — Vestimentum+

8.1 Free and Paid Tiers

Vestimentum offers two tiers:

• Free: 1 outfit suggestion / day, 5 garment uploads / day, zodiac integration off.
• Vestimentum+ (Premium): Unlimited outfits/wardrobe, optional zodiac integration, missing-piece suggestions.

8.2 Billing

• Vestimentum+ subscriptions automatically renew on a monthly or yearly basis.
• Billing is handled by Apple App Store or Google Play Store; we do not directly receive your payment information.
• Prices may change; existing subscribers will be notified of any price increase at least 30 days in advance.

8.3 Cancellation

• You may cancel via the in-app flow or directly from your Apple App Store / Google Play account settings.
• Cancellation takes effect at the end of the current billing period; you retain premium access until then.
• Refund policy: Because billing is handled by the store, refunds are subject to the relevant store’s policy (Apple / Google). In Türkiye, under the Distance Contracts Regulation, services performed instantly by electronic means and intangible (digital) content supplied instantly are among the exceptions to the right of withdrawal; the 14-day withdrawal right may therefore be unavailable once supply of the subscription’s digital content has begun. This exception applies only where the pre-contractual information and consent requirements — as updated by the 24 May 2025 amendment to the Regulation — have been met; this information is presented to you clearly before purchase. EU consumers retain their rights under the Consumer Rights Directive.

8.4 Activation of Premium Features

Some premium features are not yet active and will go live when announced in-app. You will not be charged until paid subscription becomes available.

9. Intellectual Property

9.1 Our Property

The following are our intellectual property (or our licensors’) and protected by copyright, trademark, patent, and trade secret laws:

• The App’s design, interface, and user experience
• The Vestimentum brand, logo, fonts, and color palette
• The source code, API structure, and database schema
• AI prompts and the classification taxonomy
• Illustrations, icons, and other visual assets

9.2 Your Property

All User Content you upload remains your property (Section 5.1).

9.3 Feedback

If you send us feedback, suggestions, or ideas about Vestimentum, you grant us a non-exclusive, royalty-free, perpetual right to use those suggestions. We need not notify you again to incorporate your feedback into the App.

10. Termination

10.1 Termination by You

You may terminate your account at any time, for any reason, via Profile → “Delete my account.” Your data is removed per the retention periods in Section 5 of the Privacy Policy.

10.2 Termination by Us

We reserve the right to suspend or delete your account in the following cases:

• Violation of these Terms (especially Section 6 — Acceptable Use)
• Legal requirement (court order, regulatory request)
• Suspicion that your account security has been compromised
• 12 months of inactivity (long-term dormancy)

When possible, we will notify you via email before termination. Termination may occur without notice in emergency security / legal situations.

10.3 Post-Termination

Upon termination:

• Your access to Vestimentum ends
• All User Content is removed per Section 5 of the Privacy Policy
• Your active subscription is cancelled at the end of the current period
• The following sections of these Terms survive: 5 (licenses granted for past shares), 7 (disclaimer), 9 (IP), and 11-15 (warranty disclaimer, limitation of liability, indemnity, governing law, general provisions).

11. Warranty Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE MAKE NO EXPRESS OR IMPLIED WARRANTIES THAT CANNOT BE LIMITED BY LAW THAT THE APP WILL:

• Operate without interruption, error, or delay
• Be fit for a particular purpose
• Generate accurate AI suggestions
• Always preserve all your data

WARRANTIES THAT CANNOT BE LIMITED BY LAW (CONSUMER RIGHTS, ETC.) ARE NOT AFFECTED BY THIS SECTION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, special, or punitive damages arising from your use of Vestimentum (including data loss, lost profits, reputational damage, etc.).
• Our total liability is limited to the fees you paid us in the 12 months preceding the event.
• These limitations do not cover, and do not apply to, liability arising from intent or gross negligence (Turkish Code of Obligations Art. 115).
• We are not liable for damages arising from AI-generated suggestions.

Consumer-rights liabilities (under EU/Turkish consumer law) are not affected by this section.

13. Indemnity

You agree to indemnify (defend, hold harmless) us, our employees, and our licensors from third-party claims arising from:

• Your violation of these Terms
• Your unlawful use of the App
• User Content that infringes third-party intellectual property

This obligation survives termination of your account.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the Republic of Turkey.

14.2 Dispute Resolution

For disputes arising from these Terms or use of the App:

1. First step: Contact support@vestimentum.app in good faith. We will try to reach an amicable resolution within 30 days.
2. Second step: If amicable resolution fails, disputes shall be subject to the exclusive jurisdiction of the Courts and Execution Offices of İzmir, Turkey.
3. Consumer matters: Under Turkish consumer law, consumers may alternatively apply to provincial / district Consumer Arbitration Committees or Consumer Courts.

14.3 For EU Users

EU residents retain their rights under GDPR and local consumer protection laws. EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

15. General Provisions

15.1 Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between us and supersede all prior oral or written agreements.

15.2 Assignment

You may not transfer your rights and obligations to anyone else. We may transfer our rights under these Terms (e.g., in case of a corporate merger) with prior notice to you.

15.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.

15.4 No Waiver

Our failure to exercise a right does not constitute a waiver of that right.

15.5 Force Majeure

We are not liable for failure to perform our obligations due to events beyond our reasonable control, including natural disasters, war, pandemics, internet infrastructure failures, or governmental actions.

16. Changes to These Terms

We may update these Terms from time to time:

• Material changes: Announced via in-app notification at least 14 days in advance.
• Minor changes: Updated silently; the “Last updated” date is refreshed.

Your continued use of the App after material changes constitutes acceptance of the updated Terms.

These Terms of Service were prepared with reference to the Turkish Code of Obligations, Turkish Consumer Protection Law (TKHK), KVKK, Apple App Store, and Google Play Developer Distribution Agreement. They do not constitute formal legal advice; review by a lawyer is recommended before production launch.
